Terms of Use

v2.12_21.10.26

Effective and last updated: 21 October 2026

These Terms allocate responsibilities without attempting to waive mandatory consumer or privacy rights. Qreate is publicly available software and guild administrators remain responsible for the modules and data processing they enable. The AI assistant can make mistakes, and the authority level you set for it is your choice and your responsibility.

1. Agreement and operator

These Terms are a binding agreement between you and Qreate, the trading name of its individual operator, established in the Netherlands (“Qreate”, “we”, “us”). They apply to qreate.gg, the dashboard, Discord bot, verification pages, AI Crew, support and related services (the “Service”). By using the Service or adding the bot to a server, you agree to these Terms and the Privacy Policy. If you act for an organisation or Discord server, you confirm that you can bind it. Contact: [email protected].

2. Eligibility and consumer rights

You must be at least 13 years old, meet Discord's applicable minimum age where that is higher, and have legal capacity to agree. If local law requires parental consent, you may use the Service only with that consent. You must maintain a valid Discord account and comply with Discord's terms and policies. Nothing in these Terms excludes mandatory consumer, privacy or other rights that cannot lawfully be waived. If you are an EU consumer, mandatory protections and the courts available under applicable consumer law remain available to you.

3. The Service

Qreate provides configurable Discord community-management features, including moderation, verification, roles, tickets, logging, automation, publishing, engagement, analytics and AI-assisted guidance. Qreate is a publicly available SaaS product; specific features, integrations or programs may separately be labelled beta, preview or limited availability where that is the case. Features, limits and integrations may change, and some functions depend on Discord or other providers. Unless a separate written service-level agreement says otherwise, we do not guarantee uninterrupted availability, preservation of content, or any particular result. Connected AI clients. You may connect Qreate to an AI client that supports the Model Context Protocol, such as ChatGPT, Claude or Cursor, and approve what it may do: read, plan, or apply. A connected client works with your authority and within the permissions you approved. Preparing a plan never changes your server; a change or a message is applied only after you approve it, and a connected client cannot delete channels, roles, messages or records or act against members. The AI client and its provider are third-party services under their own terms. Use through a connected client counts against your account's usage allowance and credits in the same way as the dashboard. You can disconnect a client at any time. Usage allowance. Some features cost us money each time they run, such as answers and pictures from Q, web search, voice and AI steps in automations. During early access there is no limit on them. The limits that will apply to each plan, and how credits work, will be set out in these Terms and on the pricing page before any of them applies to you.

4. Plans, payments and usage

Qreate has a free plan and paid plans. What each plan includes, its limits and its price for your country are shown on the pricing page and again at checkout. A plan belongs to an account and covers the servers that account runs, up to the plan's number of servers. Payments. Our order process is conducted by our payment provider Creem (Armitage Labs OÜ, Tallinn, Estonia). Creem is the Merchant of Record for all our orders: it sells the subscription to you, handles payment, invoices, sales tax and refunds, and its buyer terms apply to the purchase. Before you subscribe, the checkout shows the price, the applicable tax, the billing interval, the trial and the renewal terms. Trial, renewal and cancellation. Paid plans start with a 3-day free trial that needs a payment method. Unless you cancel before the trial ends, the first payment is taken when it ends. A subscription renews automatically each month or year until you cancel it. You can cancel at any time from your account page; you keep the paid plan until the end of the period you paid for, and nothing is charged after that. Refunds follow our Refund Policy and your statutory rights. If we change the price of a plan, we tell existing subscribers before the change applies at their next renewal, and you can cancel before then. Usage allowance. Features that run on AI (Q's answers, pictures, web searches, voice, AI steps in automations and briefings, AI moderation and similar) use a monthly allowance measured in credits. The allowance belongs to the account and is shared by its servers. It refills on the same day each month, counted from the start of your subscription or, on the free plan, from when you created your account, and what is left does not carry over. A trial includes a share of the monthly allowance. Credits you buy do not expire; credits earned from votes expire as shown when they are given. When the allowance and your credits are used up, AI features pause until the next refill or until more credits are added. Features that do not use AI keep working. Accounts from the beta. Accounts created during the open beta move to the Legacy plan when the open Studio campaign ends on 22 October 2026. On a Legacy account, everything already set up on its servers keeps running and stays editable until the end of 5 December 2026, and anything new follows the free plan's limits. After that date, features above the free plan need a paid plan. If a server switches off a feature that belongs to a paid plan, turning it back on needs that plan. No account is moved onto a paid plan, and nothing is charged, unless its owner chooses a paid plan at checkout.

5. Accounts, authority and security

You can sign in with Discord, with Google, or with an email address and a password. With Discord and Google, Qreate never receives your password for those services. Where you set a Qreate password, we store only a one-way hash of it and cannot read it back. Two accounts are treated as one person, and linked, only when they share an email address that the provider has confirmed. An address you have not confirmed is never used to link anything. Until you confirm your email address you can use the free parts of the Service, but you cannot start or change a paid plan and some features that carry a cost to us stay unavailable. We will tell you which, and how to confirm, at the point you try. You are responsible for your accounts, authorised users, credentials, server permissions and activity under your access, and we recommend switching on two-factor authentication in your account settings. Notify [email protected] promptly about suspected compromise. Only connect or configure a server if you have authority to do so. Qreate may request broad Discord permissions because enabled modules perform administrative actions. Discord role hierarchy still applies. Review settings, previews and permissions before publishing or enabling automation.

6. Guild administrator obligations

A guild administrator controls which modules run and is responsible for its server rules, configuration, notices, legal basis, retention choices, moderator access, webhook destinations and content. You must inform members about relevant processing and honour their rights. You must not instruct Qreate to process data unlawfully or collect unnecessary sensitive data. Where Qreate processes member data solely on your documented instructions, you are controller and Qreate is processor. Before production use requiring an Article 28 data-processing agreement, contact us; these public Terms alone are not represented as a complete bespoke DPA. Qreate's AI assistant operates under an authority level that the server owner sets. By default it prepares changes and waits for a person to approve each one. Raising that level, or enabling the ability to delete, instructs Qreate to carry out actions on your server on your behalf, in some cases without a separate approval for each action. That is a choice you make for your server, and you accept responsibility for what the assistant does within the level you have set, including where its output is inaccurate or where it acts on an instruction it has misunderstood. Only the server owner can raise the level; anyone with dashboard access to the server can lower it. Deleting a channel or a role on Discord is permanent. Discord provides no way to restore either, and Qreate cannot recover the messages, attachments, pins or identifiers involved. Before any deletion Qreate shows you the affected object as it exists on your server and requires your confirmation. Nothing in the Service reverses a deletion, and you should not rely on the ability to undo one.

7. Your content and instructions

You retain rights in content and configurations you submit. You grant Qreate a worldwide, non-exclusive, royalty-free licence to host, reproduce, transform, transmit and display them only as needed to operate, secure and improve the Service and fulfil your instructions. You represent that you have the necessary rights and lawful basis. QAssets files are stored and delivered through managed infrastructure so they can appear in Discord and other integrations. They receive stable public URLs under assets.qreate.gg, and files uploaded earlier keep working at their assets.qreate.cloud addresses. Treat an uploaded asset as public to anyone with its URL. Archiving does not remove it; use permanent deletion to request removal from Qreate storage. You remain responsible for the file, its legality, rights and intended audience, and understand that cached or third-party copies may remain after deletion. Do not submit secrets, payment-card data, special-category personal data, illegal material, or content whose processing is unnecessary. You are responsible for reviewing AI output, automations and scheduled actions before relying on them. AI output may be inaccurate and is not legal, medical, financial or professional advice. The assistant can make mistakes. It can misread an instruction, act on the wrong object, or state something about your server that is not correct. Review what it proposes before you approve it, and review what it has done where it acts under an authority level you have raised. Qreate records the changes the assistant applies so you can see and, where technically possible, reverse them.

8. Acceptable use

You must not use the Service to break law or Discord rules; harass, exploit, discriminate against or endanger people; facilitate spam, malware, fraud, sexual exploitation or illegal content; use image generation or any other AI feature to create sexually explicit or NSFW content, content depicting minors in a sexual or violent way, or realistic images of real people without their consent, including deepfakes and impersonation; infringe privacy or intellectual-property rights; scrape or profile people without a lawful basis; evade rate limits, verification, safety or access controls; probe or access systems without permission; reverse engineer except where that right cannot lawfully be restricted; overload the Service; or resell/access-share the Service without written permission. You also must not use Qreate to make solely automated decisions with legal or similarly significant effects about individuals.

9. Enforcement and cooperation

We may investigate suspected misuse, preserve relevant evidence, limit one or more features, remove content, suspend a user or guild, suspend the Service for a linked guild, or terminate access when reasonably necessary to protect users, Qreate, providers or the public, comply with law, preserve service integrity, or enforce these Terms. A feature restriction may cover a module, image generation, Q Assistant or another identified part of the Service. A guild suspension may leave the bot installed while commands, automations, publishing and configuration changes are unavailable. Existing settings and proportionate evidence may be retained while the restriction is reviewed. We do not generally monitor every message for misuse. When we receive and record a specific credible safety signal, we may act on the relevant Qreate access, preserve proportionate evidence and report it to Discord or competent authorities where appropriate. Restricting a person does not automatically suspend every guild they own. A guild or feature restriction requires its own proportionate decision based on the available evidence. Where practicable and safe, we will provide a clear category for the decision, its duration where one is set, and a route to request review. We may act without advance notice where delay could create a safety, security, legal, provider or service-integrity risk. External notice may be withheld or delayed where it would expose another person, evidence or an investigation. We may cooperate with Discord and competent authorities in response to valid requests. Where content is published through the Workshop, the same principle applies proportionately to it: a submission may be approved, returned for changes, rejected, unpublished, withdrawn or suspended, before or after publication, and publication is never automatic. We may remove a recommendation, unlist or suspend a listing, quarantine an asset or pause an automation where that is reasonably necessary on the grounds above, including a misleading claim about what a scenario does, its origin, its security properties or who made it. A visible route to report a listing is provided, and a report on its own is not a decision: it is a reason for a person to look. Where a decision affects you and it is safe and practical to say so, we will say so, and you can ask for it to be reviewed without charge.

10. Third-party services

The Service depends on Discord and may use infrastructure, security, messaging, AI, notification and integration providers. An administrator can also enable third-party content services or a webhook. Their terms and availability apply independently. Qreate is not responsible for their outages, policy or API changes, account actions, or content, but this does not limit Qreate's responsibility where applicable law makes us responsible for our selection or use of a processor. The Privacy Policy describes the categories of recipients, and the current detailed register is available to authenticated server administrators in the dashboard.

11. Qreate intellectual property

Qreate and its software, branding, designs and documentation are owned by or licensed to the operator. Subject to these Terms, you receive a limited, non-exclusive, non-transferable, revocable right to use the hosted Service for its intended purpose. No source-code, trademark or other ownership right is transferred. Feedback may be used without restriction or payment, provided we do not identify you publicly without permission.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available”. We disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement, and do not promise that the Service, AI output, moderation outcome, backups or integrations will be uninterrupted, accurate, secure or error-free. These disclaimers do not exclude warranties or remedies that applicable consumer law makes mandatory. This applies in particular to the AI assistant, which can make mistakes, and to actions it takes under an authority level you have raised. We do not warrant that its output is correct or that an action it takes matches what you intended.

13. Limitation of liability

To the maximum extent permitted by applicable law, Qreate is not liable for indirect or consequential loss, lost profit, revenue, goodwill, opportunity or data arising from use of the Service. For a free Service, Qreate's aggregate liability arising from the Service is limited to EUR 100; for a paid Service, it is limited to the greater of EUR 100 or the fees you paid Qreate for the affected Service during the 12 months before the event. The limitations do not apply to fraud, wilful misconduct, death or personal injury caused by negligence, breach of mandatory data-protection obligations, or any liability that cannot lawfully be excluded or limited. Nothing here shifts liability to you for conduct for which Qreate is legally responsible.

14. Business-user indemnity

If you use the Service for a business or organisation, you will indemnify Qreate against third-party claims, losses and reasonable costs caused by your unlawful content, configuration, instructions, material breach of these Terms, or infringement of another person's rights. This clause does not apply to consumers to the extent prohibited by law and does not cover loss caused by Qreate's own breach, negligence or wilful misconduct.

15. Termination and data

You may stop using the Service, sign out and remove the bot at any time. Removing the bot stops future bot activity and does not by itself delete stored records. A removed server's configuration is kept for 24 months so an authorised administrator can pick up where they left off, and can be deleted sooner on request. Deletion requests can be made from Privacy and data in the dashboard, or under the Privacy Policy. We may discontinue the Service or terminate access for material breach, security risk, legal requirement or provider dependency. Where reasonably practicable, we will give notice. Clauses that by nature should survive, such as ownership, accrued payment obligations, disclaimers, liability limits and dispute provisions, survive termination.

16. Changes

We may change the Service and these Terms. We will post the new version and effective date and use reasonable advance notice for material changes where practicable. Changes do not retroactively remove accrued rights. If a material change requires renewed agreement under applicable law, we will request it; mere continued use is not substituted for consent where consent is legally required.

17. Law and disputes

Dutch law governs these Terms, excluding conflict-of-law rules, but this choice does not deprive an EU consumer of mandatory protections of the country where they habitually reside. Contact [email protected] first so we can try to resolve a dispute informally. For business users, courts in the Netherlands have exclusive jurisdiction. Consumers may bring proceedings in any court available under mandatory law; Qreate will not rely on this clause to remove that right.

18. General terms and contact

If a provision is unenforceable, it is limited or removed only as necessary and the rest remains effective. A failure to enforce is not a waiver. You may not assign this agreement without consent; Qreate may assign it as part of a genuine business transfer, subject to applicable law and notice where required. These Terms and the Privacy Policy are the entire agreement for the general Service, except for a signed DPA, order form or SLA.
